Terms of Service

Welcome to Pets & Plus. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Pets & Plus, LLC ("Pets & Plus," "we," "us," or "our"), a limited liability company organized under the laws of the State of Florida. By accessing or using our website, mobile applications, or any related services (collectively, the "Platform"), you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must discontinue use of the Platform immediately.

1. Acceptance of Terms

By creating an account, browsing listings, or otherwise using the Platform, you confirm that you are at least 18 years of age and have the legal capacity to enter into a binding agreement. If you are accessing the Platform on behalf of a business or organization, you represent and warrant that you have the authority to bind that entity to these Terms, and references to "you" shall include both you individually and the entity you represent.

2. Account Registration

To access certain features of the Platform, you must register for an account. When registering, you agree to:

  • Provide accurate, current, and complete information during the registration process.
  • Maintain and promptly update your account information to keep it accurate and current.
  • Keep your login credentials confidential and not share your account with any third party.
  • Accept responsibility for all activity that occurs under your account, whether authorized by you or not.
  • Notify us immediately at [email protected] if you suspect any unauthorized access to your account.

We reserve the right to suspend or terminate any account that we reasonably believe has been compromised, is being used fraudulently, or violates these Terms.

3. User Conduct

You agree to use the Platform only for lawful purposes and in a manner consistent with these Terms. You shall not:

  • Post or transmit any content that is false, misleading, defamatory, harassing, threatening, or otherwise objectionable.
  • List animals that have been obtained through illegal means, including but not limited to animals taken from the wild in violation of applicable wildlife protection laws.
  • Misrepresent the breed, health status, age, temperament, or lineage of any animal listed on the Platform.
  • Use the Platform to facilitate puppy mill operations or any breeding practices that violate applicable animal welfare laws.
  • Attempt to circumvent, disable, or interfere with any security features of the Platform.
  • Use automated scripts, bots, or scraping tools to access or collect data from the Platform without our prior written consent.
  • Engage in any activity that could damage, overburden, or impair the functionality of the Platform.

4. Listings & Transactions

Pets & Plus provides a platform for breeders and sellers ("Sellers") to list animals and for prospective buyers ("Buyers") to discover and connect with Sellers. We are not a party to any transaction between Buyers and Sellers, and we do not guarantee the quality, safety, legality, or availability of any animal listed on the Platform.

Sellers are solely responsible for the accuracy of their listings, including descriptions, photographs, pricing, health records, and any claims about breed certification or pedigree. Sellers must comply with all applicable federal, state, and local laws governing the sale and transport of animals.

Buyers are responsible for conducting their own due diligence before completing any purchase. We strongly recommend visiting the breeder's facility, requesting veterinary records, and verifying licensing before finalizing any transaction.

5. Intellectual Property

All content on the Platform, including but not limited to text, graphics, logos, icons, images, software, and the compilation thereof, is the property of Pets & Plus, LLC or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws.

By submitting content to the Platform (including listing photos, descriptions, and reviews), you grant Pets & Plus a non-exclusive, worldwide, royalty-free, perpetual license to use, reproduce, modify, adapt, publish, and display such content in connection with the operation and promotion of the Platform. You retain ownership of your original content.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PETS & PLUS, LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM.

Our total aggregate liability for any claims arising out of or related to these Terms or your use of the Platform shall not exceed the greater of (a) the total fees paid by you to Pets & Plus during the twelve (12) months preceding the claim, or (b) one hundred U.S. dollars ($100.00).

Pets & Plus does not guarantee the health, temperament, or genetic condition of any animal listed on the Platform. Any transactions, agreements, or arrangements made between Buyers and Sellers are solely between those parties.

7. Termination

We may suspend or terminate your access to the Platform at any time, with or without cause, and with or without notice. Grounds for termination include, but are not limited to, violations of these Terms, fraudulent or illegal activity, failure to pay applicable fees, or conduct that we determine to be harmful to other users or the integrity of the Platform.

You may terminate your account at any time by contacting us at [email protected]. Upon termination, your right to use the Platform will cease immediately, and any data associated with your account may be deleted in accordance with our Privacy Policy.

8. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or your use of the Platform shall be resolved exclusively in the state or federal courts located in Miami-Dade County, Florida, and you consent to the personal jurisdiction of such courts.

Before initiating any formal legal proceedings, you agree to first attempt to resolve the dispute informally by contacting us at [email protected]. We will make reasonable efforts to resolve any dispute within thirty (30) days of receipt of your written notice.

9. Changes to These Terms

Pets & Plus reserves the right to modify these Terms at any time. When we make material changes, we will update the "Last updated" date at the top of this page and, where appropriate, notify you via email or through a prominent notice on the Platform. Your continued use of the Platform after any such modifications constitutes your acceptance of the revised Terms.

We encourage you to review these Terms periodically to stay informed about your rights and obligations when using the Platform.
