Breeder Agreement

This Breeder Agreement ("Agreement") is entered into between you ("Breeder," "you," or "your") and Pets & Plus, LLC ("Pets & Plus," "we," "us," or "our") and governs your participation as a breeder on the Pets & Plus platform (the "Platform"). By registering as a breeder and listing animals on the Platform, you agree to comply with the terms set forth in this Agreement, as well as our Terms of Service and Privacy Policy.

1. Eligibility & Licensing Requirements

To list animals on the Platform, you must meet all of the following requirements:

  • Hold all licenses and permits required by federal, state, and local laws for the breeding, sale, and transport of animals. This includes, where applicable, USDA licensing under the Animal Welfare Act.
  • Maintain current and valid business registration in your jurisdiction of operation.
  • Provide copies of all relevant licenses and permits during the registration process and promptly update them upon renewal or change.
  • Be at least 18 years of age and legally authorized to enter into binding agreements.
  • Have no prior convictions for animal cruelty, neglect, or related offenses.

Pets & Plus reserves the right to verify any credentials you provide and may request additional documentation at any time. Failure to provide requested documentation within fourteen (14) days may result in suspension of your account.

2. Health Records & Facility Standards

Breeders listed on Pets & Plus are expected to maintain the highest standards of animal welfare. You agree to:

  • Maintain comprehensive veterinary health records for every animal listed, including vaccination history, deworming schedules, and genetic health testing results where applicable.
  • Ensure all animals receive regular veterinary care from a licensed veterinarian and are in good health at the time of sale.
  • Provide a minimum health guarantee of fourteen (14) days for all animals sold through the Platform, covering congenital defects and communicable diseases present at the time of sale.
  • Operate breeding facilities that meet or exceed the standards established by the American Kennel Club (AKC) or equivalent breed-specific organizations, including adequate space, sanitation, ventilation, and socialization.
  • Allow facility inspections by Pets & Plus or its designated representatives upon reasonable notice, if requested as part of our screening program.

3. Listing Obligations

When creating and managing listings on the Platform, you agree to:

  • Accurate Information: Provide truthful and complete descriptions of every animal, including breed, age, sex, color, temperament, known health conditions, and any genetic testing results. Misrepresentation of breed, lineage, or health status is grounds for immediate account termination.
  • Honest Photography: Use only current, unaltered photographs of the specific animal being offered. Stock photos, photos of different animals, or digitally enhanced images are strictly prohibited.
  • Accurate Pricing: Display the full purchase price of the animal. Any additional fees (shipping, veterinary deposits, registration fees) must be clearly disclosed in the listing.
  • Timely Responses: Respond to buyer inquiries within forty-eight (48) hours. Consistent failure to respond may result in reduced listing visibility or account suspension.
  • Listing Updates: Promptly remove or mark as sold any animal that is no longer available. Listings for animals that have been sold, reserved, or are otherwise unavailable must be updated within twenty-four (24) hours.

4. Fees & Commission Structure

Pets & Plus charges the following fees for use of the Platform:

  • Listing Fee: Basic listings are free. Premium listing placements with enhanced visibility and featured positioning are available for a monthly subscription fee, as detailed on our pricing page.
  • Transaction Commission: A standard commission of 5% is charged on the final sale price of every completed transaction facilitated through the Platform. This commission is deducted from the sale proceeds before disbursement to the Breeder.
  • Payment Processing: Third-party payment processing fees (currently 2.9% + $0.30 per transaction, charged by Stripe) are borne by the Breeder and are separate from the Pets & Plus commission.

Commissions are calculated on the sale price of the animal only and do not apply to shipping fees or other ancillary charges. Pets & Plus will provide a monthly statement detailing all transactions and fees. Disbursements to Breeders are processed within seven (7) business days of a completed sale.

5. Termination

Either party may terminate this Agreement at any time with thirty (30) days' written notice. Pets & Plus may terminate this Agreement immediately, without prior notice, if:

  • You breach any material term of this Agreement, the Terms of Service, or any applicable law.
  • You receive multiple verified complaints from buyers regarding misrepresentation, animal health, or failure to honor commitments.
  • Your breeding license or required permits are revoked, suspended, or expire without renewal.
  • You are found to be operating a puppy mill or engaging in breeding practices that violate our animal welfare standards.
  • You engage in fraudulent activity, including but not limited to fake listings, false reviews, or payment fraud.

Upon termination, all active listings will be removed, and any pending transactions will be handled in accordance with our buyer protection policies. Commissions owed on completed transactions remain due regardless of termination.

6. Dispute Resolution

In the event of a dispute between a Breeder and a Buyer, Pets & Plus may, at its sole discretion, facilitate a resolution process. This may include:

  • Reviewing evidence submitted by both parties, including communications, photographs, veterinary records, and transaction documentation.
  • Requesting additional information or documentation from either party within a specified timeframe.
  • Issuing a recommended resolution, which may include a partial or full refund, exchange, or other appropriate remedy.
  • Suspending the Breeder's account pending resolution if there is evidence of misrepresentation or violation of this Agreement.

Disputes that cannot be resolved through the Platform's internal process shall be subject to the governing law and dispute resolution provisions set forth in our Terms of Service.
